Much of today's writing on medical ethics is strong on philosophical theory or on legal speculation, but weak on practice. In this book, practitioners in a wide range of specialties describe the process of making ethical decisions in their everyday work. A moral philosopher analyzes their conclusions, and the theological implications are developed by a Christian theologian and Rabbinic scholar. In some young children brought by their parents for diagnosis of acute life-threatening events investigations suggested imposed apnoea as the cause rather than spontaneous occurrence. Covert video surveillance of the cot in which the baby was monitored allowed confirmation or rebuttal of this diagnosis. That parents were not informed of the video recording was essential for diagnosis and we assert ethically justifiable as the child was the patient to whom a predominant duty of care was owed. When the editor invites comment on a response to an analysis of a criticism of a protocol already defended by the author in this journal, the issue is clearly contentious. I will comment briefly on Thomas's paper in this issue of the journal, and look at points of agreement as well as dissent.

Objective: To develop an approach for seeking informed consent to examine tissues retained from a previous study of sudden infant death syndrome as part of a study on asthma, and to document responses and participation rate.Design: Pilot open-ended approach to 10 volunteer SIDS parents, followed by staged approach to seek consent from the target SIDS families for the asthma study.Participants: Parents of SIDS infants known to SIDS and Kids Victoria and parents of SIDS infants from the 1991–2 SIDS in Victoria (...) case–control study.Main outcomes: Qualitative responses of the piloted parents and study parents, and participation rates.Results: The pilot group responses were used to refine the written material to be provided. Of the 72 families for which contact details were available, 45 gave verbal consent for contact by the Victorian Institute of Forensic Medicine regarding the asthma study, three refused and 24 did not respond to two letters. Thirty-three completed consent forms, all positive for participation in the asthma study, giving a positive response rate of 73% .Conclusions: The use of postmortem tissue for research is acceptable to the next of kin when an approach is sensitive to their concerns and needs and is made by experienced counsellors from a familiar organisation. Despite the painful memories evoked by the approach of the research group, the acceptance rate among those who could be contacted was high. (shrink)

Problematic substance use (PSU) among nurses has wide‐ranging adverse implications. A critical integrative literature review was conducted with an emphasis on building knowledge regarding the influence of structural factors within nurses' professional environments on nurses with PSU. Five thematic categories emerged: (i) access, (ii) stress, and (iii) attitudes as contributory factors, (iv) treatment policies for nurses with PSU, and (v) the culture of the nursing profession. Conclusions were that an overemphasis on individual culpability and failing predominates in the literature and (...) that crucial knowledge gaps exist regarding the influence of structural factors on driving and shaping nurses' substance use. Compared to approach motivation, avoidance motivation evokes vigilance, attention to detail, systematic information processing, and the recruitment of cognitive resources. From a conservation of energy perspective it follows that people would be reluctant to engage in the kind of effortful cognitive processing evoked by avoidance motivation, unless the benefits of expending this energy outweigh the costs. We put forward three empirically testable propositions concerning approach and avoidance motivation, investment of energy, and the consequences of such investments. Specifically, we propose that (...) compared to approach-motivated people, avoidance-motivated people (a) carefully select situations in which they exert such cognitive effort, (b) only perform well in the absence of distracters that occupy cognitive resources, and (c) become depleted after exerting such cognitive effort. Some considerations are urgent and others are not. Sometimes we invite criticism if we neglect the urgency of our situation, even if our action seems adequate to respond to it. Despite this significance, the literature does not offer a satisfactory analysis of the normative structure of urgency. I examine three views of urgency, drawn from philosophical and adjacent literature, which fail to explain the distinctive criticism we face when we neglect the urgency of our reasons. Instead I argue that urgent (...) considerations pre-empt our deliberation about less urgent considerations. Urgency, then, is a meta-normative phenomenon, setting standards for how we handle and respond to first-order considerations, requiring that we close deliberation. In the face of urgency, appropriate action is not enough: commitment is called for. This is how we enact appreciation of our practical reasons, independently of our carrying out the action they call for. (shrink)

Are Hegel and Nietzsche philosophical opposites? Can twentieth-century Continental philosophers be categorized as either Hegelians or Nietzscheans? In this book Elliot Jurist places Hegel and Nietzsche in conversation with each other, reassessing their relationship in a way that affirms its complexity. Jurist examines Hegel's and Nietzsche's claim that philosophy and culture are linked and explicates the various meanings of "culture" in their work--in particular, the contrast both thinkers draw between ancient and modern culture. He evaluates their positions on the (...) failure of modern culture and on the need to develop conceptions of satisfied agency. It is Jurist's original contribution to focus on the psychological sensibility that informs the project of both philosophers. This article proposes that predicate order and coherence relations are the two major determining factors in copredication licensing, resolving a long-standing puzzle over the criteria for constructing acceptable copredications. The effects of predicate ordering are claimed to be anchored around semantic complexity, such that copredications with semantically Simple–Complex predicate orderings are more acceptable than the reverse. This motivates a parsing bias, termed Incremental Semantic Complexity. Particular ways of implementing this parsing bias are discussed. The effect of predicate coherence is claimed (...) to be anchored around a sense of causality and featural commonality. Lastly, a hierarchy of possible copredications is outlined (the Copredication Hierarchy), helping to delimit the modelling of copredications to a greater extent than has previously been possible. This essay concerns two forms of moral non-naturalism according to which general moral principles or laws enter into the grounding explanations of particular moral facts. According to bridge-law non-naturalism, the laws are themselves partial grounds of the moral facts; whereas according to grounding-law non-naturalism, the laws explain the grounding connections that obtain between particular natural facts and particular moral facts. I pose and develop an objection to BLNN concerning moral worth: as compared to GLNN, BLNN has trouble accommodating the common (...) intuition that actions performed out of motivation for rightness de dicto are, at least in paradigm cases, deficient in their moral worth as compared to those performed out of motivation for rightness de re. After presenting the moral worth objection to BLNN, I respond to a possible defense of the view and explain why GLNN is not itself imperiled by an analogous objection. I finally argue that in light of the moral worth objection, a purported analogy between the law and morality fails to give us any reason to prefer BLNN to GLNN. I conclude that non-naturalists who accept the existence of general and explanatory moral principles should adopt GLNN rather than BLNN. (shrink)

Philosophers cannot agree on whether the rule of Countable Additivity should be an axiom of probability. Edwin T. Jaynes attacks the problem in a way which is original to him and passed over in the current debate about the principle: he says the debate only arises because of an erroneous use of mathematical infinity. I argue that this solution fails, but I construct a different argument which, I argue, salvages the spirit of the more general point Jaynes makes. I argue (...) that in Jaynes’s objective Bayesianism we might have good reasons to adopt Countable Additivity, and some of the major problems this adoption is known to entail need not worry us. In particular, I propose to adopt this new angle on Countable Additivity in Jon Williamson’s version of objective Bayesianism. (shrink)

He reveals crucial aspects of Heidegger's thinking that betray an affinity with dimensions of Jewish thought.

Abstract:Bipolar or related disorders (BoRD) present unique practical and existential problems for people who live with them. All agents experience changes in the things they care about over time. However people living with BoRD face drastic shifts in what seems valuable to them, which upset their longitudinal values (if, indeed, any stable longitudinal values are available in the first place). Navigating these evaluative high seas presents agents living with BoRD with a distinctive existential question, not shared by those on calmer (...) waters. I draw out two contrasting ways in which someone living with BoRD might seek to support their self-determination in these circumstances, by crafting appropriate self care and support regimes. The first strategy involves managing one’s affective episodes so that they do not interrupt one’s plans and long-term agency over time. The second involves a regimen that allows one the greatest degree of freedom in adapting to changes in one’s experiences of value. What distinguishes these sorts of self-determination is the scope at which they are predicated. Although both sorts of self-determination allow an individual to rule themselves, they alter the overall shape of one’s autonomy in quite different ways. (shrink)

Dreams have attracted the curiosity of humankind for millennia. In A Dream Interpreted Within a Dream, Elliot Wolfson guides the reader through contemporary philosophical and scientific models to the archaic wisdom that the dream state and waking reality are on an equal phenomenal footing--that the phenomenal world is the dream from which one must awaken by waking to the dream that one is merely dreaming that one is awake. By interpreting the dream within the dream, one ascertains the wakeful (...) character of the dream and the dreamful character of wakefulness. Assuming that the manner in which the act of dreaming is interpreted may illuminate the way the interpreter comprehends human nature more generally, Wolfson draws on psychoanalysis, phenomenology, and neuroscience to elucidate the phenomenon of dreaming in a vast array of biblical, rabbinic, philosophical, and kabbalistic texts. To understand the dream, Wolfson writes, it is necessary to embrace the paradox of the fictional truth--a truth whose authenticity can be gauged only from the standpoint of its artificiality. The dream, on this score, may be considered the semblance of the simulacrum, wherein truth is not opposed to deception because the appearance of truthfulness cannot be determined independently of the truthfulness of appearance. Efficiency as quantified and promoted by cost-effectiveness analysis sometimes conflicts with equity and other ethical values, such as the “rule of rescue” or rights-based ethical values. We describe the utilitarian foundations of cost-effectiveness analysis and compare it with alternative ethical principles. We find that while fallible, utilitarianism is usually superior to the alternatives. This is primarily because efficiency – the maximization of health benefits under a budget constraint – is itself an important ethical value. Other ethical frames may be irrelevant, (...) incompatible with each other, or have unacceptable implications. When alternatives to efficiency are considered for precedence, we propose that it is critical to quantify the trade-offs, in particular, the lost health benefits associated with divergence from strict efficiency criteria. Using an example from HIV prevention in a high-prevalence African country, we show that favoring a rights-based decision could result in 92–118 added HIV infections per $100,000 of spending, compared to one based on cost-effectiveness. Through an extensive examination of the conceptions of social justice that may be ascribed validly to Karl Marx's political thougtht, Elliot R. Pruzan analyzes the apparent conflict between Marx as value-neutral social scientist and as revolutionary. He suggests a resolution to this conflict through a carefully constructed presentation of Marx's theory of human nature and the ethical presuppositions of that theory. In so doing, Pruzan identifies those elements of Marx's political thought that warrant our continued serious consideration of it (...) as a genuine theory of politics, especially when compared with other more traditionally conceived forms of political thought.
